1. DEFINITIONS

“Company” refers to Motion Masters Limited

“Workshops” refers to Saturday Masters Intensive dance workshops

“Participant” refers to any person attending our workshops

“Terms” refers to these Terms and Conditions

“Website” refers to https://motionmasters.co.uk

2. ACCEPTANCE OF TERMS

These Terms and Conditions govern the use of www.motionmasters.co.uk and participation in workshops organized by Motion Masters Ltd, a company registered in England and Wales.

By using this Site or participating in our workshops, you confirm that you have read, understood, and agree to these Terms and Conditions.

Services will be provided with reasonable care and skill, as described, and within a reasonable time in accordance with the Consumer Rights Act 2015.

3. BOOKING AND PAYMENT

3.1 Payment Processing

All payments are processed through our third-party booking platform, Bookwhen. We accept:

  • Credit Card
  • Debit Card

3.2 Payment Authorization

By providing payment information, you authorize processing of the full workshop fee at the time of booking.

3.3 Payment Terms

  • Payment must be made online only
  • Full payment must be confirmed at least 6 hours before the workshop
  • If payment fails within 6 hours of the workshop, your booking will be automatically cancelled, and you will be notified via email.
  • Participants are responsible for monitoring their payment status
  • No participant will be admitted without confirmed payment

3.4 Payment Issues

If payment is disputed or fails, we reserve the right to cancel your booking in accordance with our booking platform’s policies.

4. CANCELLATION AND REFUND POLICY

4.1 Participant Cancellations

  • 72+ hours notice: Full refund minus £5 administration fee
  • Less than 72 hours notice: No refund provided
  • Exceptional circumstances: Refunds may be considered for proven serious illness, accident, or other emergencies at the Company’s discretion. Email info@motionmasters.co.uk with supporting documentation. Requests must be submitted within 5 to 15 working days of the scheduled workshop.

4.2 Company Cancellations

Low enrollment: If minimum enrollment (10 participants) is not met, we will cancel with 48 hours notice and provide full refunds

Other reasons:

  •  If Motion Masters cancels for any other reason, participants receive full refunds
  • Weather/emergency: Extreme weather or emergency cancellations will be decided 2 hours before workshop start with full refund or rescheduling offered

4.3 Refund Processing

Refunds processed to original payment method via booking platform

Processing time: 5–15 business days

Administrative fees apply as stated above

5. AGE REQUIREMENTS AND ELIGIBILITY

5.1 Age Policy

Workshops are suitable for participants aged 13 and over with appropriate consent and supervision requirements as follows:

5.2 Minors (13–17 years)

  • Ages 13–15: Must have parent/guardian present at drop-off and collection
  • Ages 16–17: May attend independently with signed parental consent
  • All minors: Require completed and submitted parental consent form before workshop attendance
  • Any minor attending without proper consent will be excluded for safeguarding reasons without refund
  • Motion Masters staff are DBS checked where required by law.

5.3 Adult Participants (18+)

  • No additional consent requirements
  • Must complete standard health declaration form

6. HEALTH AND SAFETY

6.1 Health Declaration Requirements

All participants must complete a mandatory health screening form before attendance, including:

  • Current fitness level assessment
  • Any medical conditions or physical limitations
  • Current medications affecting physical activity
  • Previous injuries relevant to dance/movement
  • Emergency contact information

Failure to complete or providing false information may result in exclusion without refund and could void insurance coverage. We reserve the right to request proof of medical clearance if necessary.

6.2 Fitness Requirements

Participants must be physically capable of moderate exercise

Those with health concerns must consult medical professionals before attending

We reserve the right to exclude participants if their participation poses safety risks

Participants must immediately inform instructors of any discomfort or injury

6.3 Medical Disclaimer

Motion Masters staff are not medically qualified

Participants attend workshops at their own risk regarding their personal fitness and health decisions

We strongly recommend personal accident and medical insurance coverage but no mandatory

6.4 Emergency Procedures

  • Medical emergencies: Call 999 immediately, then notify Motion Masters contact
  • Emergency contacts: Motion Masters maintains participant emergency contact information
  • First aid: Basic first aid facilities available at all venues
  • Accident reporting: All incidents must be reported immediately and documented within 24 hours

7. CONDUCT AND BEHAVIOR

7.1 Expected Behavior

Respectful conduct toward instructors and participants

Follow all instructor and studio staff directions

Comply with all applicable laws

No disruptive, inappropriate, or dangerous behavior

Violations result in immediate exclusion without refund.

7.2 Facility Requirements

Footwear: Clean indoor trainers/dance shoes (never worn outside) – MANDATORY

Attire: Appropriate dance clothing, hair secured, no loose jewelry

Studio care: Water only (secure lids), respect equipment, dispose of waste properly, report damage immediately

7.3 Late Arrivals

Participants arriving late may be refused entry for safety reasons

No refunds for missed workshops due to late arrival

Recommendation: Arrive 10–15 minutes early

8. INTELLECTUAL PROPERTY

8.1 Choreography Rights

All choreography taught belongs to the respective instructors

Participants may practice learned choreography personally

Prohibited: Teaching, reproducing, or commercially using choreography without written permission from the instructor

8.2 Recording Prohibition

Strictly prohibited: Recording, filming, or photographing during workshops by participants

Violations: Result in immediate exclusion without refundAuthorized recording: Only Motion Masters may record for promotional purposes

9. PHOTOGRAPHY AND MEDIA CONSENT

9.1 Photography/Filming Policy

Motion Masters may photograph and film workshops for business, marketing, and social media purposes.

9.2 Consent Process

Separate consent required: Photography consent must be given via designated consent checkbox during booking

Withdrawal: Consent may be withdrawn at any time by emailing info@motionmasters.co.uk

Non-consent: Participants who do not consent may be excluded from activities where filming occurs

Usage: Consented images/videos may be used on website, social media, and marketing materials

Previously published materials may remain in use unless otherwise agreed in writing.

9.3 Rights Granted

Participants who consent grant Motion Masters permission to use their likeness in photographs and videos for promotional purposes without additional payment.

10. DATA PROTECTION

10.1 Legal Basis for Processing

We process personal data under the following legal bases:

  • Contract performance: Booking and workshop administration
  • Legitimate interest: Safety, emergency procedures, and business operations
  • Consent: Marketing communications and photography (where separately consented)

10.2 Third-Party Platform

Workshop bookings are processed through Bookwhen. Review their privacy policy at https://bookwhen.com/privacy

Payment processing: All payments are handled by our third-party payment processor (Stripe) – we do not store your payment details

10.3 Data We Collect

  • Booking data: Name, contact details, payment information (via Bookwhen)
  • Health data: Mandatory health declaration information ( including, name , email, phone number )
  • Emergency contacts: Required for safety purposes
  • Marketing: Newsletter subscriptions (opt-in only)

10.4 Your Rights

You may:

  • Opt-out of marketing communications anytime
  • Request access to your personal data
  • Request data deletion (subject to safety/legal requirements)
  • Withdraw consent for photography/marketing
  • Contact info@motionmasters.co.uk for data protection queries

10.5 Data Sharing

Personal data is never shared with third parties except:

  • Emergency services (if required for safety)
  • Our booking platform (Bookwhen) for transaction processing and Stripe for payment processing
  • Legal compliance requirements

11. LIABILITY AND INSURANCE

11.1 Our Liability

We are liable for:

  • Death or personal injury caused by our negligence
  • Breach of our statutory duties under consumer protection law
  • Fraud or fraudulent misrepresentation

Our liability is limited to the extent permitted by law for:

  • Indirect or consequential losses
  • Loss of profits or business opportunity
  • Losses exceeding the total amount paid for workshops

11.2 Participant Responsibility

Participants are responsible for:

  • Assessing their own fitness and ability to participate safely
  • Following all safety instructions and workshop rules
  • Their personal belongings and property
  • Medical expenses arising from their participation

11.3 Insurance Coverage

Motion Masters: Maintains public liability insurance as required by law

Participants: Responsible for their own personal insurance coverage

Recommendation: Personal accident and medical insurance strongly advised

Exclusions: Our insurance does not cover participant property, medical expenses, or travel costs

11.4 Time Limits for Claims

Written notice of claims must be given within 30 days of incident

Legal proceedings must commence within 12 months of incident

Participants are advised to report any incident before leaving the venue, where possible.

Failure to comply makes claims time-barred

12. WORKSHOP CHANGES

12.1 Schedule and Content Changes

Workshop times, instructors, or content may change due to circumstances beyond our control

We provide maximum possible notice for changes

Substantial changes may entitle participants to refunds at our discretion

12.2 Instructor Changes

Instructors may be substituted due to illness or other unavoidable circumstances

We will secure replacement instructors of equivalent professional standard

If no suitable replacement: Full refunds provided

Notification: As soon as possible when changes occur

Refund requests: Must be made within 7 days of change notification

13. COMPLAINTS AND DISPUTES

13.1 Complaints Procedure

Method: Email complaints to info@motionmasters.co.uk

Acknowledgment: Within 5 business days

Resolution target: Within 15 business days

Escalation: Unresolved complaints may be referred to alternative dispute resolution

13.2 Dispute Resolution

Primary method: Good faith negotiation

Mediation: If negotiation fails, both parties agree to engage in mediation in accordance with the CEDR Model Mediation Procedure (or a comparable alternative) in England and Wales

Legal jurisdiction: English courts have exclusive jurisdiction

Small claims: Both parties retain right to small claims court for appropriate matters

Governing law: Laws of England and Wales apply

14. FORCE MAJEURE

We are not liable for failure to perform due to circumstances beyond reasonable control, including:

  • Natural disasters, extreme weather
  • Government restrictions, lockdowns, or public health emergencies
  • Venue closure by authorities
  • Instructor illness or transport strikes
  • Public emergency situations
  • Response: We will make reasonable efforts to reschedule or provide refunds as appropriate.

15. GENERAL PROVISIONS

15.1 Entire Agreement

These Terms constitute the entire agreement between participants and Motion Masters. Modifications require written agreement.

15.2 Severability

If any provision is unenforceable, the remainder remains in effect. Invalid provisions will be replaced with valid provisions of similar intent.

15.3 Updates

Motion Masters may update these Terms at any time. Updated terms apply to bookings made after the update date and will be posted on our website.
